1. What Draftly is
Draftly is a software tool that helps you draft South African workplace documents based on the information you provide and, for employers, your own loaded disciplinary code. Draftly is operated under Optimised Holdings. By using Draftly you agree to these terms.
2. Not legal advice
Draftly is not a law firm, labour consultancy, or registered practitioner, and using it does not create any professional relationship. The documents it produces are drafts based on your inputs. You are responsible for reviewing every document for accuracy, completeness, and appropriateness before you rely on or act on it. For complex disputes you should consult a qualified labour relations practitioner. Unfair dismissal disputes must be referred to the CCMA within 30 days, and unfair labour practice disputes within 90 days.
3. Your responsibilities
You confirm that the information you submit is accurate and that you are entitled to use it. You must not use Draftly to harass, defame, or unlawfully target any person, or to generate documents you are not authorised to create. You are responsible for keeping your account credentials secure.
4. Plans, payments and refunds
Employer accounts may start on a free trial. Paid subscriptions and per-case employee documents are charged at the prices shown at the time of purchase, processed by our payment provider (PayFast). If a document you have paid for fails to generate, you are entitled to a refund of that charge.
5. Availability and changes
We aim to keep Draftly available but do not guarantee uninterrupted service. We may update, suspend, or discontinue features, and we may amend these terms. Continued use after a change means you accept the updated terms.
6. Limitation of liability
To the maximum extent permitted by law, Draftly and Optimised Holdings are not liable for any indirect or consequential loss, or for any outcome of a hearing, dispute, or process in which a Draftly-generated document is used. Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.
7. Privacy
Our handling of your personal information is described in our Privacy Policy, which forms part of these terms.
8. Governing law
These terms are governed by the laws of the Republic of South Africa.
